Eugen C. Andres and Jim Moore of Andres & Andres provide a practical discussion of current ethical issues to keep you out of trouble with your clients, the courts and the state bar. This presentation is intended as an overview of the common ethical issues that arise in the attorney-client relationship. The largest part of the presenters’ practice is representing plaintiffs in legal malpractice lawsuits and the presentation is oriented toward issues that are common in legal malpractice cases.
The emphasis of the course is avoiding ethical and malpractice problems that arise at the beginning and the end of the relationship. The main topics addressed include pre-retainer screening, retainer agreements, communications with clients during representation, terminating the attorney-client relationship, settling a case, and distributing the funds post settlement. Further areas covered include researching the client, important pre-screening factors, contingency agreements, hourly agreements, errors & omissions insurance, conflicts of interest, keeping the client reasonable informed, delivering bad news to the client, types of client communications, permissive & mandatory withdrawal, returning the client’s file, communicating offers to the client, multiple clients, distribution sheets and client trust accounts.
Eugen C. Andres received his B.A. Degree from UCLA in 1961. For the first 15 years of his practice, Mr. Andres concentrated on criminal law, serving as a Deputy District Attorney and then doing criminal defense work. For the past 25 years, Mr. Andres has concentrated on civil litigation. The emphasis of his practice has been directed toward representing plaintiffs in substantial cases involving professional negligence, personal injury and general civil litigation. Jim Moore received his B.A. Degree from California State University in 1995 and his J.D. from Western State University in May of 1999. Mr. Moore joined Andres & Andres in 1999 and has been involved with all aspects of legal and medical malpractice litigation.
