Sexting, Texting & Facebook: First Amendment Issues in Schools

Attorney Gretchen Shipley provides a wonderful analysis of the legal issues faced by today’s schools in our new Digital Age. Web 2.0 has made it much easier to share information – but this may not be a good thing for students and teachers. Issues discussed include cyberspeech & the First Amendment, cyberbullying, sexting, smart phones in schools, cell phone search & seizure, the Mousouri Facebook teacher ban, texting, school Facebook pages, and Acceptable Use Policies (AUPs). Ms. Shipley also analyzes case law from around the country to shed light on the ‘substantial disruption’ standard. Case law discussed: J.S. v. Blue Mountain School District, Lavine v. Blaine School District, T.V. v. Smith-Green Community School Corp., J.C. v. Beverly Hills Unified School District, and San Diego Unified School District v. Commission on Professional Competence.
